Apple faces down Qualcomm, Ericsson over EU patent fees

Apple faces down Qualcomm, Ericsson over EU patent fees

Apple faces down Qualcomm, Ericsson over EU patent fees
BRUSSELS: The European Union is drawing up guidelines on how much patent holders should charge for their technologies, a thorny issue that pits Apple and other users against Qualcomm and Ericsson.

Trillions of dollars in sales are at stake as regulators ponder whether a fridge maker should pay a different rate for crucial patents than a carmaker, or whether a flat, fixed rate would be fairer.

The patent fee model used by world No. 1 smartphone chip designer Qualcomm, which bases royalties on a product's total cost, predominates in the tech industry but is opposed by Apple and others in Silicon Valley.

Other models are in use and the EU aims to set a uniform one for Europe, opening a new front in a global dispute that has already seen multiple lawsuits between Apple and Qualcomm.

Antti Peltomaki, deputy director general at the European Commission, told a conference last week that the EU hopes to finalise its guidelines by the end of the year. They will not be legally binding but could provide a basis if the EU executive decides to enact rules in future.

The move is part of the bloc's broader push to set new rules of the road for internet-connected devices beyond just computers and smartphones to cover cars, home automation and energy devices, aiming to ensure job creation and other economic benefits in the so-called Internet of Things (IoT) era.

The Commission, however, has yet to make a final decision on which technology patent fee model it favours.

Silicon Valley tech giants have sided with Apple, as have big Asian electronics makers who work for Apple, including Foxconn Technology Group.

Qualcomm, which holds what many experts see as the world's most lucrative smartphone patent portfolio, is backed by major mobile phone and network patent holders Ericsson and Nokia. (http://reut.rs/2yzqvCc)

Apple, the automotive industry and product makers say a fairer approach is to link royalties to the cost of the smallest saleable unit.

"It is not reasonable to charge more for use of the very same component in a Mercedes versus a Hyundai or a car versus a bicycle. This is discriminatory based on price of the end product, both within and outside of a particular product category," Apple said of Qualcomm's model in a May submission to the European Commission.

Apple and Qualcomm declined to comment for this story.

Industry estimates show IoT systems could represent a market of more than $11 trillion per year by 2025.

"There's a lot of potential value at stake," said Matthew Hunt, competition attorney with the law firm Bristows in London.

BALANCING ACT

Qualcomm's royalty approach, known as used-based or value-based, is an important source of profits for other mobile pioneers such as Ericsson and Nokia.

Ericsson, once the world's biggest mobile phone and network equipment maker, has fallen on hard times in the past decade in the face of stiff global competition. Still, with more than 42,000 patents giving it the largest number of mobile technology patents, it stands by the value-based licensing model.

"We need to be able to be flexible to differentiate the price. Flexibility is absolutely necessary," Patrick Hofkens, Ericsson's director of intellectual property rights policy, said.

Hofkens said that charging high royalty rates discourages product makers from adopting new innovations, while setting royalty rates too low undermines new technology developers from licensing their patents to industry standards bodies, which enable mass markets to take off.

"Price differentiation allows for lower prices for applications that do not use the patented technology as intensively as others," the Ericsson executive said.

The European Commission has a tough balancing act, said Bristows' Hunt.

"For any model, the main difficulty is going to be how to determine a fair rate. This has proven complicated enough in the mobile telecoms industry already, and it's only going to get harder with new IoT enabled products," he said.

The Qualcomm view means royalties for essential patents are based on the total cost of a product. Its previous patent licensing deal with Apple, for example, allowed it to take a percentage of the overall selling price for the iPhone, in exchange for supplying it with modem chips.

Lobbying group the App Association (ACT), backed by Apple, Facebook, Intel, Microsoft and Oracle, urged the commission not to rush into setting new guidelines.

IP Europe, another lobbying group whose members include Ericsson, Airbus, Nokia and Orange, says patent holders deserve a fair compensation.

"When they are contributors to a platform, they have expectations of fair remuneration," the group's executive secretary Francisco Mingorance said.

New PlayStation VR Headset Announced

New PlayStation VR Headset Announced
New PlayStation VR Headset Announced
Sony has announced a new, updated PlayStation VR (PS VR) headset. It will improve on the design of the existing PS VR unit in several ways, though none of them monumental enough to warrant trading yours in for a new one or waiting for it to hit the market (it has no release date yet). The news was made public via an update to the PS VR FAQ on Sony's PlayStation blog.
"A hardware update to PlayStation VR is being prepared. The new version, model number CUH-ZVR2, features an updated design that enables the stereo headphone cables to be integrated with the VR headset and a slimmer, streamlined connection cable. There’s also an updated Processor Unit that supports HDR pass through, enabling users to enjoy HDR-compatible PS4 content on a TV without having to disconnect the Processor Unit in between the TV and the PS4 system. This function can be used only when the VR headset is turned off," reads the post. Sony's PlayStation Japan site has more images of what it looks like. This comes after Sony India had finally informed retailers that the  PS VR headset for the PS4 gets a price cut in India. Launched around six months ago, Sony’s virtual reality headset is now Rs. 4,000 cheaper than what it was at launch, making the new PS VR India price Rs. 37,990. This includes the PS VR headset, cables, demo disc, and most importantly, the PS4 camera needed for VR. Previously, the PS VR with camera would cost Rs. 41,990.
In our PS VR review we noted that while comfortable, the mess of wires made it far from ideal, but considering the price of other headsets such as HTC Vive, it still is the cheapest way to experience VR and the price cut makes it all the more affordable, if you already own a PS4- which isn't getting a price cut in India just yet. Granted the new PS VR revision makes it less of a mess of wires, but it's not at a point where it should be. Hopefully, Sony makes PS VR 2 wireless.

Moto X Play Starts Receiving Android 7.1.1 Nougat Update: Report

Moto X Play Starts Receiving Android 7.1.1 Nougat Update: Report
Moto X Play Starts Receiving Android 7.1.1 Nougat Update: Report
Moto India back in June confirmed that the Moto X Play will be updated to Nougat though no exact release date was announced. If some reports are to be believed then the Moto X Play has started receiving Android 7.1.1 Nougat update in the Brazil region.
Notably, the company in June did not mention whether it will be rolling out Android 7.0 Nougat or straight away upgrade the Moto X Play to a higher (Android 7.1.1) version. To recall, the phone was launched back in 2015 in India at Rs. 18,499.
Considering the Android 7.1.1 Nougat update has just shown up for select users in Brazil, we can expect it to take some time to reach Moto X Play units in India. Those who haven't received a notification for the update can head to Settings > About Phone > System updates to check for availability, and then if an update is available, download and install.
The Android 7.1.1 Nougat update was rolled out to users in December last year, and was touted as "an update to Nougat" by Google. It adds new emojis that reflect gender equality and also adds support for GIF images directly from keyboard on supported apps. Google Allo, Google Messenger, and Hangouts were some of the apps that supported GIF images. The Android 7.1.1 Nougat update also added app shortcuts which allowed users to launch actions on any apps by simply long pressing the app icon.
A Twitter user spotted the update in the Moto X Play forum, and the news was first reported by The Android Soul. Last month, the company started rolling out Android 7.1.1 Nougat update to Moto Z Play smartphone.

Motorola finally releases Android 7.1.1 Nougat update for Moto X Play

Well, Moto X Play owners there is some good news for you. While Moto India has already confirmed that Moto X Play would be updated to Nougat, the smartphone has reportedly started receiving Android 7.1.1 Nougat. However, the update has been rolled out in Brazil as we write this.
A Twitter user has spotted the update in the Moto X Play forum, and the news was first reported by The Android Soul. In any case, now that the Android 7.1.1 Nougat update seems to have started rolling out in Brazil, Moto X Play (review) units in India should also be getting the update in the coming days. Better check your notification panel once in a while.  Users should receive a notification for the update. If not, then they can always go to Settings > About Phone > System updates to check for availability manually. If the update is available then they can download and install the same. In any case, Moto X Play users will now be able to experience Android 7.1.1 Nougat hands-on. Besides, the update will bring features like split screen mode, better battery life, new emojis that reflect gender equality and support for GIF images directly from the keyboard on supported apps. The Android 7.1.1 Nougat update also brings app shortcuts which will allow users to launch actions on any apps by simply long pressing the app icon. And there's more. Apart from the OS upgrade, the update will most probably bring the latest security patch to the device as well. So with the new security patch, the handset will be safe and secure from malicious attacks. Notably, the company has also announced the list of smartphones that will be getting the latest version of Android that is Oreo. Motorola has said that the update will basically be rolled out starting in fall. Besides, you can check the list here.Meanwhile, if you have got the update then you can let us know in the comments what changes you have noticed.

Google cooperating with Russia probe after Twitter slammed
MENLO PARK: Google says it is digging into its vaults for evidence of Russian meddling in the 2016 election, after Virginia Senator Mark Warner slammed Twitter for a response to a congressional probe he called inadequate.

The search giant said in a statement Friday evening that it is cooperating with inquiries and is looking for how it can help with any relevant information.

Google, Facebook and Twitter have all been invited to appear at public hearings in October by the House intelligence committee and November 1 by the Senate intelligence committee.

After Twitter told congressional investigators in a closed door meeting Friday it had suspended at least two dozen accounts that may have been tied to Russia, Warner told reporters the response was inadequate and had mostly relied on data from Facebook.

While this amounts to Rs. 4,500 for the three-year period, on returning the phone before three years, users will have to pay a penalty based on how early they return. The buyers need to keep in mind that they can get the complete refund only on returning it within 36 to 39 months from the date of issue.Given that the first batch of JioPhone delivery started, the company has suspended the bookings temporarily, the users can register their interest via the official website or MyJio app or any offline Jio retailer. The confirmation regarding the next batch of pre-booking is yet to be announced.

Facebook testing facial recognition for unlocking accounts
It was a matter of time before technology giants joined in the FaceID bandwagon. Not that it is something new and has been around for a while but since Apple unveiled the feature on its iPhone X, it was expected to gain more traction. A media report on Tech Crunch states that Facebook is now set to get its own version of Face ID.

According to the report, the social media giant is testing a method to regain access to a Facebook account by using facial recognition. In case you get locked out of your Facebook account, the Face ID could come in really handy.

Tech Crunch quotes a spokesman of Facebook saying, "We are testing a new feature for people who want to quickly and easily verify account ownership during the account recovery process. This optional feature is available only on devices you've already used to log in. It is another step, alongside two-factor authentication via SMS, that were taking to make sure account owners can confirm their identity."

Are you being tracked on internet? Know how to find out

Yes, you are being tracked on internet and several entities are keeping dossier on you. It is so common that you must have found that out yourself. Google does it all the time and so do your social media sites.

When and where the new feature will be rolled out isn't exactly clear. No other information about Facebook's FaceID feature is known as of now.

Meanwhile, in India, Facebook is making it easier for users to donate blood. A new feature has been added to Facebook where users can sign up as blood donors and a message will show in their news feed. The feature started showing up showing up on the timeline from today (October 1), which is also the National Blood Donor Day.

The social media platform has tied up with nonprofit organizations, health industry experts, potential donors and others for this initiative.
